In its general practice, this area is in charge of providing timely information and advice to its clients on: (i) ) the requirements that the different kind of works must contain in accordance with regulations in force, in order to avoid copyright violations; (ii) deposit of works before the Competent National Office and its corresponding procedure; (iii) the legal use of third parties' works; and (iv) possible copyright violations, among other consultations involving such rights.

This area renders advice in the field of new technologies in Internet, web pages, on-line productions and domain names; it has advised a number of companies in the construction of the terms and conditions of web pages, on line courses, logotype correct use and of links in Web pages; in the registration of domain names and its possible conflicts with third party trademarks.

Furthermore, aware of the importance of the artistic, literary and musical creation for development of nations, Brigard & Castro provides a complete advice to work generators such as artists, interpreters, musicians and designers, among other persons of the artistic and entertainment world.

The Copyright and Entertainment Law area, renders advice to the Authors in drafting, review and negotiation of the works production agreements, that must be entered into by virtue of the production thereof, in addition to a complete advice in the right of correct use of the image and on other agreements that work authors must execute before third parties (assignment of patrimonial rights of author, service agreements, releases, among other agreements) providing clear opinions and with efficient solutions on this matter.

It renders advice for creation of the company policies in handling copyright, so that its employees, service suppliers and contractors, may know the principles, guidelines and requirements of the organization on this matter.



COPYRIGHTS

The copyright is defined as the recognition of the society to the intellectual effort of the creator of an artistic, literary or scientific work, as well to interpreters or performing artists, radio broadcasting organisms and phonogram producers.

The copyright contemplates two kinds of rights:

Moral Rights: They do not expire, are not subject to embargo, are inalienable and perpetual.

These moral rights may be summarized in the right granted to the author of an artistic, literary or scientific work, to appear always as the author thereof, either under its name or with a pseudonym and to oppose to any amendment, transformation or mutilation of the work which may harm the author's dignity.

Patrimonial Rights : This is deemed as the economic compensation that may be received for a work during its public performance, reproduction, communication, editing, etc.

These rights are negotiable, i.e. they may be assigned in whole or in part.

The term of these rights is for the term of the author's life and eighty years more after his decease.
